1. The Service
The Service lets businesses add tracking numbers for parcel, LTL, FTL, ocean container and air cargo shipments, see events, milestones and predicted ETAs in one dashboard, receive alerts, show a branded tracking page to their own customers, and connect other systems through integrations and an API. Features available to you depend on your plan as described on the pricing page.
2. Business use and accounts
The Service is for business use only. You must be at least 18 and authorized to bind the Customer. You keep sign-in details confidential and are responsible for activity under your account and the users you invite. Each user seat is for one named person.
3. Subscription plans and prices
The Service is sold only as a subscription. Current plans are Starter ($49 per month), Growth ($149 per month), Pro ($499 per month) and Enterprise ($1,499 per month), each also offered billed yearly at 50 percent off the monthly price. Prices, limits and features are shown on the pricing page and in checkout, and the price shown at checkout applies. Prices exclude taxes, which are added where required. The only free use is the single number lookup on the website, which is not a plan.
4. Payment and automatic renewal
You pay in advance for each billing period (monthly or yearly). Your subscription renews automatically at the end of each period for the same period at the then current price, and we charge the payment method on file, until you cancel. If a renewal payment fails, we retry it and may suspend access until it succeeds. We notify you before any price change takes effect for your next period.
5. Cancellation
You can cancel at any time in the billing section of your account settings. Cancellation stops the next renewal. Access continues until the end of the period already paid, and the charge for that period is not refunded. Payment rules are described in the refund policy, which forms part of these Terms.
6. Limits per billing period
Each plan includes a number of shipments added per billing period (parcel, LTL, FTL and air shipments, plus ocean containers counted separately), a number of users and a history period. Limits count shipments added during the period. Deleting, archiving or closing a shipment does not restore quota, and unused quota does not carry over. Quota resets at the start of each new billing period. When you reach a limit you can upgrade or wait for the next period.
7. Upgrades and downgrades
When you move to a more expensive plan or from monthly to yearly billing, the prorated difference is charged immediately, and the new plan is active once that payment succeeds. If the payment fails, you stay on your current plan. A downgrade takes effect at the next renewal and does not create a refund or credit.
8. One subscription per company
A company holds one subscription. To get more capacity, upgrade the existing subscription instead of buying a second one. 3PLs serving several clients use client sub-accounts on the Pro and Enterprise plans.
9. Acceptable use
You agree not to:
- add tracking numbers you have no legitimate business reason to follow, or use the Service to monitor people;
- resell or share access outside your company, or share one user seat among several people;
- scrape, overload or probe the Service, bypass limits, or reverse engineer it except as permitted by law;
- upload malware or content that is unlawful or infringes the rights of others;
- send notifications to consignees without a lawful basis, or use customer notification emails for marketing;
- use the Service in breach of export control, sanctions or other applicable laws.
We may suspend or close an account that breaches this section.
10. Your data
You keep all rights to the shipment data and consignee data you add. You grant us a license to process it only to provide, secure and improve the Service. You are responsible for having a lawful basis to share consignee data with us. We process personal information as described in the privacy policy. You can export your data while your account is active.
11. Carrier data and ETA accuracy
Shipment events come from carriers, ocean lines, airlines, terminals and other third party sources. We do not control those sources and do not promise that events are complete, correct or timely. Predicted ETAs are predictions based on available events and history, not commitments by us or by any carrier. Do not rely on the Service as the only basis for decisions where a late or missing event could cause harm, such as perishable cargo, hazardous goods or contractual deadlines. Carrier names and marks belong to their owners and no affiliation is implied.
12. Availability and support
We work to keep the Service available and may perform maintenance. The Enterprise plan includes a 99.9 percent uptime service level as described for that plan. Support is provided by email at support@shipmentvisibility.com and in the dashboard.
13. Intellectual property
The Service, software, design and content are owned by us or our licensors. Subject to these Terms and payment, you receive a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you send may be used without obligation.
14. Disclaimer
Except as expressly stated in these Terms, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent allowed by law.
15. Limitation of liability
To the extent allowed by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, or for demurrage, detention, storage, spoilage or penalties arising from shipment delays. Our total liability for all claims relating to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.
16. Indemnity
You will defend and indemnify us against third party claims arising from your data, your notifications to consignees or your breach of these Terms.
17. Suspension and termination
We may suspend or terminate access for non-payment, breach of these Terms, risk to the security of the Service, or a chargeback opened without first contacting us. On termination you may request an export of your data within 30 days, after which it is deleted in line with the privacy policy.
18. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law rules. The state and federal courts located in Delaware have exclusive jurisdiction, unless mandatory law gives you a different forum.
19. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. Material changes are announced by email at least 14 days before they take effect, and continued use after that date means acceptance.
